Capio CEO Mark Detrick issued the following statement in response to a federal district court order vacating the Consumer Financial Protection Bureau rule barring medical debt from credit reports:
“Removing medical debt from credit reports would have hurt doctors, hospitals, and the patients we all seek to protect. I commend the Court for ruling—at the request of the current administration—that the Bureau exceeded its authority in pursuing this deeply-flawed rule.”
“Further, I am grateful the Court has acknowledged that the Fair Credit Reporting Act preempts any state law prohibiting a credit reporting agency from furnishing a report that includes medical debt.”
“This important ruling clears the way for new, common-sense solutions that protect both patients and providers. This is a moment for industry to step up—with solutions that work for patients, providers, and the broader healthcare ecosystem. At Capio, we are proud of our Patient Bill of Rights, which outlines our commitments to accuracy, transparency, and compassion. We understand that medical debt is different—that’s why we don’t charge interest or fees, and never pursue litigation against patients. This should be common practice.”
“At the same time, more can be done to make medical debt resolution fairer, more transparent, and more supportive of patients’ long-term financial health. A system that only reports negatively is not sustainable—and it diverges from how other major financial obligations like mortgages, rent, and credit card payments are treated. Positive credit reporting can give patients the opportunity to build or improve their credit through on-time repayment, while recognizing the distinct nature of medical debt.”
“We urge Congress to take up this issue and advance solutions that reflect both the realities of medical debt and the dignity of the people behind it.”
